Additional New Hampshire Department of Labor Changes

Employees now have 36 months to file a wage claim with the New Hampshire Department of Labor (previously, wage claims had to be filed within 18 months).

The amendment also increases the maximum fine that the Commissioner may impose from $1,000.00 to $2,500.00 per violation.

Overall, the amendments to New Hampshire’s wage and hour law provide a mixed bag – they allow employees an additional 18 months to file wage claims, but they provide employers with more flexibility in making deductions from wages.

Employers are cautioned, however, not to lose sight of the prerequisite that these deductions only may be made if the employee has authorized the deduction in writing.
